How does a medical examination following an accident proceed?

A medical examination, whether agreed between the parties or ordered by a court, allows a medical expert to assess the consequences of the accident for the victim (stabilisation of the condition, lasting effects, incapacity) so that the heads of loss to be compensated can be quantified.

What heads of loss may be compensated following personal injury?

Compensation may cover pecuniary losses (medical expenses, loss of earnings) and non-pecuniary losses (pain and suffering, cosmetic damage or loss of amenity), in accordance with the classification generally applied by the courts.

What is the Victims’ Compensation Board (CIVI)?

The Victims’ Compensation Board is a civil court which allows certain victims of criminal offences to obtain compensation for their loss through national solidarity, in particular where the perpetrator is insolvent or has not been identified.

What time limits apply to bringing a personal injury claim?

A personal injury claim is, in principle, subject to a ten-year limitation period running from the stabilisation of the initial or aggravated injury, subject to particular rules depending on the origin of the damage.
